1. Agreement to Terms

By downloading, accessing, or using Naked (the “App”), you agree to these Terms of Service (“Terms”). If you do not agree, do not use the App. You should also read our Privacy Policy, which explains how we handle your data.

2. Who We Are & What We Provide

Naked is a self-help mental wellbeing app providing educational content, tools, and techniques (the “Service”). We do not provide medical advice, diagnosis, or treatment, and the App is not a medical device. Always consult a qualified professional with any questions about a mental or physical health condition. Do not use the App in an emergency—contact local emergency services or a crisis hotline in your country.

3. Eligibility

  • You must be 16+ to use the App.

  • If you are 16–17, you confirm you have permission from a parent/guardian to use the App.

  • You must have the legal capacity to enter a contract in your country of residence.

4. Accounts & Security

  • You are responsible for maintaining the confidentiality of your login and for all activity under your account.

  • Tell us promptly at support@naked.health if you suspect unauthorised use.

  • We may suspend or disable accounts for suspected breach of these Terms, safety concerns, fraud, or unlawful use.

5. Subscriptions, Free Trials & Billing

  • The App offers free features and optional paid subscriptions (“Premium”).

  • If you purchase via the Apple App Store or Google Play, billing and cancellations are handled by those stores and subject to their terms.

  • Auto-renewal: Paid plans renew automatically at the end of each period unless you cancel at least 24 hours before renewal in your app store settings.

  • Price changes: We may change prices for future periods. We’ll notify you in-app or by email before the change takes effect.

  • Trials & promos: If you start a free/introductory trial, you’ll be charged at the end of the trial unless you cancel before it ends.

  • Refunds: Where purchased through app stores, refunds are managed by the relevant store. Nothing in this section affects your statutory rights.

  • Prices include/exclude applicable taxes as stated at checkout.

6. Your Content

  • Journals are private. We do not use your journal entries to train AI, and we do not sell or share journal content for advertising.

  • You control your entries, including deletion, via the App. After deletion, we may retain minimal records where required by law (e.g., transaction logs).

  • Please do not record content that is illegal, abusive, or threatens harm. We do not actively monitor journals but may act if we receive lawful notices or urgent risk reports.

Licence you grant to us (non-journal content)

If you submit ratings, feedback, reviews, or other non-journal content (“User Content”), you grant us a worldwide, non-exclusive, royalty-free licence to use, host, reproduce, and display that User Content solely to operate and improve the Service. You remain the owner of your content.

7. Acceptable Use

You agree not to:

  • use the App for unlawful purposes, harassment, or to promote self-harm;

  • attempt to reverse engineer, decompile, or interfere with the App;

  • upload malware or engage in security breaches;

  • impersonate others or misrepresent your affiliation;

  • scrape or mass-harvest content without written permission.

We may remove content or suspend accounts that breach these Terms.

8. AI Features

Some features use AI (e.g., content generation, recommendations, text-to-speech).

  • AI outputs may be imperfect and are provided for informational and self-help purposes only. They are not medical advice.

  • AI features are grounded in Naked’s validated resources but can still be wrong, incomplete, or not suited to your situation. Always exercise judgment.

  • We use service providers to deliver AI functionality. See our Privacy Policy for details of processing and safeguards.

  • We do not use journal entries to train AI models.

9. Intellectual Property

The App, underlying software, branding, and content are owned by Naked Mental Health Limited or our licensors and are protected by IP laws. We grant you a personal, non-exclusive, non-transferable, revocable licence to use the App for your own non-commercial purposes in accordance with these Terms. You may not copy, modify, distribute, or create derivative works except as permitted by law.

10. Third-Party Services & Links

The App may link to or integrate third-party services (e.g., app stores, cloud providers, audio delivery). We are not responsible for those services’ content or practices. Your use of them may be subject to separate terms.

11. App Availability, Updates & Changes

We may change, update, or discontinue features (including beta/experimental features) at any time. We aim for high availability but do not guarantee the App will be uninterrupted or error-free. Updates may be required to continue using the App.

12. Termination

You can stop using the App at any time and can delete your account in-app or by contacting support@naked.health. We may suspend or terminate access where you breach these Terms, misuse the Service, or where required by law. Upon termination, your licence ends and you must stop using the App. Account deletion will remove your journals from active systems; limited data may be retained as required by law.

13. Disclaimers

The Service is provided on an “as is” and “as available” basis. To the fullest extent permitted by law, we disclaim all warranties (express or implied) including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the App will meet your needs, be uninterrupted, secure, or error-free, or that AI outputs will be accurate or reliable.

14. Limitation of Liability

Nothing in these Terms limits or excludes liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, or any liability that cannot be limited under applicable law.
Subject to the foregoing, we are not liable for: (a) indirect, incidental, special, or consequential losses; (b) loss of profits, revenue, data, or goodwill; (c) errors or omissions in AI outputs or user decisions taken in reliance on the App.
To the extent permitted by law, our total aggregate liability arising out of or in connection with the Service in any 12-month period is limited to the greater of £50 or the amount you paid to us for the Service in that period. Your statutory rights are not affected.

15. Indemnity (non-consumer misuse)

If you use the App in a way that is unlawful or breaches these Terms and this causes us loss, you agree (to the extent permitted by law) to indemnify us for reasonable losses, costs, and expenses arising from your misuse.

16. Changes to These Terms

We may update these Terms from time to time. If we make material changes, we’ll provide notice (e.g., in-app or by email). Changes apply from the stated effective date. Continued use of the App after the effective date means you accept the updated Terms.

17. Governing Law & Jurisdiction

These Terms and any dispute or claim (including non-contractual disputes/claims) are governed by the laws of England and Wales. Courts of England and Wales shall have non-exclusive jurisdiction. If you are a consumer resident elsewhere, you may benefit from mandatory consumer protections in your country of residence.
